Processing purposes and legal basis

We collect, process and use your personal data for the purpose of processing contracts, maintaining customer relations and acquiring interested parties. The legal basis for this is Art. 6 (1), lit. a-c, f of the DSGVO.

Passing on

We may transfer your personal data to the following categories of recipients:

  • participating companies
  • partner enterprises
  • Service companies commissioned by us

A transfer to recipients in third countries (with the exception of Switzerland) outside the scope of the DSGVO is not planned. We do not sell or rent your personal data to third parties or market it in any other way. As part of the web analysis, we pass on the collected data to Google. Furthermore, data is passed on to the web host.

Data categories and data origin

We process the following categories of personal data: master data (e.g. first name, surname, addresses), communication data (e.g. telephone numbers, e-mail addresses).

The data from the above data categories are collected directly by us or passed on to us via an affiliated partner company. We deliberately refrain from purchasing addresses from distant third parties.

Duration of storage

We only store your personal data for the period of time necessary to achieve the storage purpose or if this has been provided for by the European Directive and Regulation Body or another legislator in laws or regulations to which the data controller is subject.

If the storage purpose no longer applies or if a storage period prescribed by the European Directive and Regulation Body or another competent legislator expires, your personal data will be blocked or deleted routinely and in accordance with the statutory provisions.

Rights of the data subject

If the legal requirements are met, you are entitled to the following rights pursuant to Art. 15 to 20 DSGVO: Right to information, correction, deletion, restriction of processing and data transferability.

Information on the customer's right of objection pursuant to Art. 21 DSGVO

  1. Right of objection in individual cases

    You have the right, for reasons arising from your particular situation, to object at any time to the processing of your personal data on the basis of Article 6 (1) e DSGVO (data processing in the public interest) and Article 6 (1) f DSGVO (data processing on the basis of a balancing of interests); this also applies to profiling based on this provision within the meaning of Article 4 (4) DSGVO. 

    If you file an objection, we will no longer process your personal data unless we can prove compelling reasons for the processing worthy of protection which outweigh your interests, rights and freedoms, or the processing serves the prosecution or defence of legal claims.

  2. Right of objection against processing of data for advertising purposes

    In individual cases we process your personal data in order to operate direct advertising. You have the right at any time to object to the processing of your personal data for the purpose of such advertising; this also applies to profiling, insofar as it is connected with such direct advertising.

    If you object to the processing for purposes of direct marketing, we will no longer process your personal data for these purposes.

    If you do not wish to receive any further advertising from us, you have the option of not only objecting to our use of your personal data, but also registering your name on our restricted list. The data in the blocked list will only be used to check whether you do not wish to receive further advertising. In this way, your interest in not receiving advertising may be better served than if your contact details were deleted from all our databases.

Revocability of consents

If the processing of your personal data is based on a previously given consent, you have the right to revoke this consent at any time. The data processing remains lawful until the time of revocation.

Consequences of non-availability

The granting of consent or the provision of personal data to us is basically voluntary. If you do not give consent, revoke a previously given consent or do not provide any personal data, this will generally not have any adverse effects on you.

The granting of consent or the provision of personal data is, however, necessary for the implementation of pre-contractual measures and for the proper execution of the contract.

Existence of automated decision-making

kühn & weyh deliberately does not use automatic decision making or profiling using your personal data.

Right of appeal to the supervisory authority

According to Art. 77 DSGVO, you have the right to complain to the supervisory authority if you are of the opinion that the processing of your personal data is unlawful.


Newsletter and Mailings

With the following information we inform you about the contents of our newsletter, the registration and dispatch procedure as well as your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.

Dispatch service provider: The newsletter is dispatched by our service provider XQueue GmbH, Christian-Pleß-Str. 11-13, 63069 Offenbach am Main. The privacy policy of the service provider can be found at: www.xqueue.de/datenschutz/. The service provider operates on the basis of our legitimate interests pursuant to Art. 6 para. 1 lit. f DSGVO. We have concluded an agreement with him on order processing pursuant to Art. 28 DSGVO. The shipping service provider will not write to you himself or pass on your data to third parties.

Contents of the newsletter: We send the newsletter in the form of emails only with the prior consent of the recipient or through the existence of a legal permission. Our newsletters contain information about us and our services.

Consent and logging: The consent to the receipt of our newsletter takes place in the so-called double opt-in procedure. As part of customer care, you can receive an e-mail from us with the registration to receive our newsletter. After receipt of your registration
we will send you an e-mail with a link to confirm your registration to receive our newsletter. The registration and confirmation to receive our newsletter will be logged by us in order to be able to prove the process in accordance with the legal requirements. Name and email address, the registration and confirmation time and also the IP address are logged. Likewise the changes of your data stored with the dispatch service provider are logged if necessary.

Registration data: To agree to receive the newsletter, it is sufficient to provide your email address. Optionally, we ask you to enter your name in the newsletter for the purpose of addressing you personally.

The recording of the consent procedure is based on our legitimate interests pursuant to Art. 6 para. 1 lit. f DSGVO. Our interest is directed towards the use of a user-friendly and secure newsletter system that serves both our business interests and your expectations as a user and also allows us to provide evidence of consent. A statistical evaluation and/or profiling with this data does not take place.

Germany: The dispatch of the consent e-mail and the newsletter is based on the consent of the recipient according to Art. 6 Para. 1 lit. a, Art. 7 DSGVO in conjunction with § 7 Para. 2 No. 3 UWG or on the legal permission according to § 7 Para. 3 UWG.

Termination/revocation: You can revoke your consent to receive our newsletter at any time. You will find a link to revoke your consent at the end of each newsletter. We may store the unsubscribed email addresses for up to three years on the basis of our legitimate interests before deleting them for the purpose of sending the newsletter. We do this in order to be able to prove a previously given consent. The processing of this data is limited to the purpose of a possible defence against claims. An individual request for deletion is possible at any time, provided that you also confirm the former existence of a consent.

Social Media

So that you can share the content of our pages on social media, share buttons from Facebook and Twitter are available. These are not embedded plug-ins of the social media providers, but HTML links with the look of the respective social media providers. The connection to the social media provider is only established when the button is clicked. You will then be redirected to the respective page of the social media provider. Before that, no personal data about you can be collected by the respective social media provider. The collection and processing of your personal data by the social media provider is based on their respective data protection information.

Provision of the website and creation of log files

A Scope of processing

Each time our website is accessed, data and information from the computer system of the accessing computer are automatically stored in log files by the web host as part of the hosting process. These data are not evaluated for marketing purposes. There is also no transfer of this data to us or other third parties.

The collection of this data is necessary to ensure that our website is displayed correctly and that the causes of any technical problems can be determined. The data is also needed to ensure operation and to analyse attacks on the website. These purposes also include our legitimate interest in data processing pursuant to Art. 6 para. 1 lit. f DSGVO.

The logged data is deleted by the webhoster as soon as it is no longer necessary to keep it for the purpose of its collection. Typically, this technical information is deleted after three days at the latest.

The collection of data for the provision of the website and the storage of data in log files is mandatory for the operation of the website. Consequently, there is no possibility of objection on the part of the user.

B Tracking technologies

  1. Google Analytics cookies
    We use cookies from Google Analytics for web tracking on our homepage. The cookies are generated and administered by methods of the Javascript library ga.js by Google. The collected data is transferred to Google and the reports created by Google enable us to analyse the surfing behaviour of the users. 
  2. Use, legal basis and purpose
    When you visit our website, you as a user are informed about the use of cookies in a so-called cookie banner. The data is stored with an anonymous IP address, so that the traceability to a certain natural person cannot be achieved or only with disproportionately high expenditure. We do not use the data for profile building or advertising purposes. We have not given any approvals for further Google services and products. We do not start tracking until you have given us your consent by clicking the button in the cookie banner. This consent is voluntary and not necessary for the use of this website. After receiving your consent, we set an "Agreed" cookie on your end device so that the decision is taken into account when the website is called up again and the cookie banner does not appear again.

    The legal basis for the processing of personal data using cookies for range measurement is Art. 6 para. 1 lit. a DSGVO.
    The purpose of tracking with cookies is to improve the quality of our website and its content. Through the analysis, we learn how the website is used and can thus constantly optimize our offer.
  3. Place and duration of storage
    Cookies are stored on your computer. You therefore have full control over the use of cookies.
